Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the trackmaxima.com website, the free calculators offered on it, and the TrackMaxima applications and services described below (together, the “Services”). The Services are operated by Cristian Marian Bursasiu PFA, a sole trader registered in Romania (“TrackMaxima”, “we”, “us”). By using any of the Services you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

These Terms apply across the TrackMaxima product family:

• Website & free calculators — the marketing site and the free TDEE, calorie, and one-rep-max (1RM) calculators, which run entirely in your browser.
• TrackMaxima Logger — a food-logging mobile application (iOS and Android). Logger is a paid application with no free tier: every new account gets a 14-day trial of the complete app with no payment card, after which continued use requires a subscription. There is no feature-level paywall inside the app.
• TrackMaxima Prep — a meal-prep and meal-coverage mobile application (iOS and Android), including a free tier and an optional paid “Premium” subscription.
• TrackMaxima Train — a gym program composer (build your own weightlifting programs, with strength calculators and a workout log), in development; some clauses below apply only once it is available.
• Waitlists — email sign-up forms used to notify you about product launches.

Product-specific terms appear in the relevant section. Where a product has its own in-app terms, those terms apply in addition to these.

2. Eligibility & accounts

You must be at least 16 years old to use the Services. Where an account is required (currently TrackMaxima Logger and TrackMaxima Prep, and later TrackMaxima Train), you are responsible for the accuracy of the information you provide and for keeping your credentials secure. You are responsible for activity that occurs under your account.

The free calculators and general website do not require an account.

3. Free calculators

The calculators are provided free of charge and perform all computations locally in your browser. They produce estimates based on published formulas (e.g. Mifflin-St Jeor, Harris-Benedict, Katch-McArdle, Epley, Brzycki). Estimates vary between individuals and are not a substitute for professional advice. See our Disclaimer.

4. Trials, subscriptions & access

Logger and Prep are sold on different terms. The clauses below state which product they apply to. Clause 4.3 applies to both.

4.1 TrackMaxima Logger — a paid app with no free tier

• Trial. Every new Logger account receives a 14-day trial of the complete application. No payment card is required, so the trial cannot and does not auto-charge, and it does not convert into a paid subscription unless you actively choose to subscribe. The trial is available once per account and is not offered again on re-registration or reinstallation.
• No free tier. When the trial ends without a subscription, access to the app’s logging features stops. There is no free tier to drop to and no reduced or read-only mode.
• Subscription. Access is an auto-renewing subscription billed through the Apple App Store or Google Play at the price shown in the app and on our website — currently USD 59.99 per year or USD 7.99 per month, or the local equivalent shown by your store. Your subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period. There is no feature-level paywall: every feature of the app is included in the trial and in the subscription.
• If your subscription ends. Your account and everything you have logged are retained, not deleted. You keep access to the parts of the app needed to export your data, delete your account, or resubscribe, and your data is waiting if you return. You will not be able to log new entries until you resubscribe.
• Exporting your data does not require a subscription. The export feature in clause 6 and in our Privacy Policy is available to you whether or not your subscription is active.

4.2 TrackMaxima Prep — free tier & Premium

• Free trial. New accounts may receive a time-limited trial with full access. No payment card is required to start the trial, and it never auto-charges. When the trial ends, the account automatically drops to the free tier unless you choose to subscribe.
• Free tier. Continues indefinitely with a limited feature set. Content you created during the trial is preserved (it may become read-only where it exceeds free-tier limits).
• Premium subscription. Premium is an auto-renewing subscription billed through the Apple App Store or Google Play at the price shown in the app. Your subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period.

4.3 Both products

• Manage or cancel your subscription in your App Store / Google Play account — we cannot cancel store subscriptions on your behalf. Cancelling stops the next renewal; it does not end the period you have already paid for.
• Refunds for store purchases are handled by Apple or Google under their policies.
• We will give notice of material price changes as required by the applicable store and by law.
• Deleting your account does not cancel your subscription, and cancelling your subscription does not delete your account. Each must be done separately.

5. Acceptable use

You agree not to: use the Services unlawfully; reverse-engineer, scrape, or overload the Services; attempt to access other users’ data; resell or redistribute the Services; or upload content that infringes others’ rights or is unlawful.

6. Your content & our content

You retain ownership of the data and content you create in the Services (e.g. recipes, packs, logs). You grant us a limited licence to host and process that content solely to provide the Services. You can export your content at any time from within the app — in Logger, regardless of whether your subscription is active (clause 4.1). System-provided content (default recipes, programs, copy, logos, and software) is owned by us or our licensors and may not be copied except as the Services allow.

7. Availability & changes

The Services are provided on an “as available” basis. We may add, change, suspend, or discontinue features (including the free calculators or any product) at any time. We aim to give reasonable notice of significant changes where practical.

8. Disclaimers & limitation of liability

The Services — including all calculations, nutrition figures, and meal-coverage indicators — are for informational purposes only and are not medical, nutritional, or professional advice. See our Disclaimer. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for decisions you make based on the Services. Nothing in these Terms limits liability that cannot be limited under Romanian or EU consumer law.

9. Termination

You may stop using the Services at any time and may delete your account from within the app. We may suspend or terminate access for breach of these Terms.

10. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-law rules. Mandatory consumer-protection rights available to you under the law of your country of residence are unaffected. Disputes are subject to the competent courts of Romania, subject to any mandatory consumer jurisdiction rules.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Services or by updating the “Last updated” date above. Continued use after changes take effect constitutes acceptance.
